What You Must Know Before Filing Your Claim

To increase your chances of approval, you must be accurate and thorough. The Social Security Administration says about 65% of initial applications for disability claims are denied. That statistic isn’t supposed to add more stress, but it does speak to the importance of filing a complete and detailed application. 

Understanding the difference between SSDI and SSI can significantly impact your benefits, as SSDI is based on your work history and contributions to Social Security. At the same time, SSI is need-based and considers your financial situation. Here are some key points to keep in mind when filing your claim:

There are Different Types of Disability Claims

When you first file your claim, you’ll be interviewed by staff at the Social Security agency. This can happen over the phone or at your local Social Security office. Determining which type of claim you should file is SSDI (Title II) based on your work history or SSI (Title XVI) based on your financial situation is crucial. 

Check if you are eligible for both types, as changes in your household income or marital status might affect your eligibility for SSI. Gather all necessary documents, such as your work history and financial information, before the interview to ensure a smooth process. Review the eligibility requirements for each type of claim to avoid any mistakes. If you are uncertain about which claim to file, consulting with an attorney will provide clarity and increase your chances of success.

Providing a Complete Medical History Makes a Difference 

Listing all the medical conditions that affect your ability to work is essential. Often, claimants only mention the most severe conditions, thinking these will be enough for a disability finding. However, every medical issue contributes to the overall picture of your disability. For example, if you mention only your spinal stenosis but leave out your depression, it could hurt your case. 

Detailing all of your conditions demonstrates how they collectively limit your work capacity. (If you’re over 50, specific regulations might apply.) Include information from all your healthcare providers, such as doctors, therapists, and specialists, to give a full view of your health. Regularly update your medical records to reflect any changes in your condition. Providing thorough documentation makes a significant difference in the outcome of your claim.

When completing the function report, explain your daily limitations. For instance, “I can sweep for 10 minutes before needing a 30-minute rest,” or “I can sit for 30 minutes before my back pain requires me to stand up and move around.” Describe your abilities on average or bad days, not just your best days, and ensure your answers are honest and consistent.

How To Create a Detailed Work History

You must provide a detailed work history for the past 5 years. Describe your job duties, including physical tasks and supervisory roles. For example, “I frequently lifted 40-pound auto parts and occasionally 80-pound tires,” and specify if you managed other people or you were able to hire and fire employees. Avoid using terms like “manager” or “supervisor” to describe your job title unless you have supervisory responsibilities, as this can affect the vocational expert’s job analysis and your disability determination.
